Sentencing Tariffs for Drink Driving

Prosecution's sentencing tariffs for s 67(1)(b) of the Road Traffic Act
An accused has a choice whether to Plead Guilty or to Claim Trial to the charge of drink-driving. Before the Court imposes sentence, he can inform the Court of matters that he thinks are relevant to sentencing.
The Prosecution will ask the Court to impose a fine and a driving disqualification order if –
An accused pleads guilty (“PG”) to his charge;
The accused has not previously been convicted on an offence of drink driving; and
The offence did not result in an accident.
The fine and driving disqualification order that the Prosecution will be seeking in cases falling under paragraph 2 will be as follows:

The Prosecution reserves the right to revise its sentencing positions in paragraph 3 should new facts or new circumstances emerge. In the event that the Prosecution decides to exercise this right, the Prosecution will inform an accused as soon as possible
